American Airlines Flight 191 Case Study Example | Topics and Well Written Essays - 500 words
American Airlines Flight 191 - Case Study Example This maintenance procedure is believed to have led to the engine separating from the wing. The procedure was carried out because McDonnell-Douglas issued a service bulletin requiring that the "upper and lower spherical bearings that attached the pylon to the wing" (Failure Analysis, 2008, pg. 1) be replaced. Instead of carrying out the procedure according to the accompanying directions, American Airlines decided to replace the assembly via a cheaper method that involved less time and effort to undertake. The aft bulkhead could have been brought into contact with the wing-mounted clevis via a number of different ways. Either during or after the hardware in the aft bulkhead fitting was removed, a load could have been applied that would have been sufficient enough to produce a crack. When attaching the pylon, the maintenance personnel had to be extremely careful because of the small distance between the pylon and wing attachments and the structural elements. It would only take a minor error for the forklift operator to damage the bulkhead and its upper flange (Failure Analysis, 2008). the airlines contributed to this accident" (Failure Analysis, 2008, pg. 1).

ZIMMER - Case Study Example patients in making amputation unnecessary and replacement of joints possible, but was a relief to health insurers such as Medicaid and health practitioners; they were able to handle such cases with much ease, at lower costs and resulted to much less suffering in the patient. It was in the 90s that the leading companies in orthopedics realigned in a competitive market, which led to massive mergers and acquisitions of other device makers that a new trend in orthopedics was designed. Companies in this period vehemently searched for smaller companies to acquire to improve their product lines, improve innovations through technologies, increase market penetration, and reduce complexity of managing rapidly growing companies, especially in spinning off major business lines by large pharmaceutical companies to reduce the size of their enterprises (Bickel, 3). As explained earlier, it was innovativeness through research and development that many companies such as Zimmer managed to venture rapidly in the market, while strategically making acquisitions to strengthen their footing in the global market. For example, through such innovativeness Zimmer became the pioneer of initiating a bloodless and less painful surgery operation, resulting in reduced trauma in a patientââ¬â¢s body tissues; such innovations opened another new page in orthopedics, a window that introduced the company to stiff competition. The strength of the company was concentrating more on research and development, to come up with new products increased its competitiveness. In addition to innovations, marketing activities were critical in defining a companyââ¬â¢s presence in any particular market. However, in this marketing approach there were unfair trends in selling of orthopedic products to hospitals. Instead of manufacturers dealing directly with major hospitals, di stributors were largely used to acquire such products. The problem was that surgeons and other medics could take advantage of such distribution

Comparison Critique of two Famous Speeches Essay
Comparison Critique of two Famous Speeches - Essay Example What makes their speeches unique and special were the contrasting messages that each speaker delivered. Though delivered at different points in American history, each president successfully managed to convey the thoughts and emotions of the American public to the world. The speech of Pres. George W. Bush was delivered before the joint session of congress back in 2001. Without the use of visual aids and backed up only by an off camera teleprompter, the president stood before the politicians and international delegates in order to express the deep gratitude of the American people for the outpouring of love and support from the international community after the terrorist attacks. This was a historically significant speech as it signaled the beginning of America's decade long war on terror that took them from the arid desert of Afghanistan all the way to the oil rich country of Iraq. It was the day that America finally joined in on the growing war on terror because of the attack on their homeland. This was in effect, similar to the speech that Pres. Roosevelt gave on the fateful day that the Japanese attacked Pearl Harbor. This speech turned the tide of history and dictated the end of the reign of terrorism in the Middle East. The opening dialogue of his speech tried to lighten the severely somber mood by reminding the American public that they were not alone in this tragedy. This was a tragedy that affected the whole world and nations such as South Korea, Britain, and others were not ashamed to show their sympathy by offering songs and prayers in support of America. After that the speech fell into its actual topic, which was how America was going to respond to the unprovoked attack and what it would cost the nation. It was not difficult to follow his train of thought during the speech as all the plans of action were laid out in a concise manner meant to educate the listener/viewer with its main ideas which were clearly supported by evidence. Americans have many qu estions tonight. Americans are asking, "Who attacked our country?"... The terrorists' directive commands them to kill Christians and Jews, to kill all Americans and make no distinctions among military and civilians, including women and children. This group and its leader, a person named Osama bin Laden, are linked to many other organizations in different countries, including the Egyptian Islamic Jihad, the Islamic Movement of Uzbekistan. (Transcript of Pres. Bush's Address) Thanks to Pres. Bush's constant quoting of verified information from government sources such as the American CIA and British MI6, all the listeners deduced that their president had the credibility to deliver the information and, therefore, must be telling the truth. By using persuasive and highly descriptive information regarding the advent of the Al-Qaeda, Pres. Bush was able to garner unprecedented national and international support that was necessary in order to mount the war on terror. He explained in his own colorful and highly descriptive words that: The evidence we have gathered, all points to a collection of loosely affiliated terrorist organizations known as Al Qaeda. They are some of the murderers indicted for bombing American embassies in Tanzania and Kenya and responsible for bombing the USS Cole. Al Qaeda is to terror what the Mafia is to crime. However, its goal is not making money; its goal is remaking the world and imposing

Sex Crime Essay Example | Topics and Well Written Essays - 1500 words
Sex Crime - Essay Example "After a three-year period of consultation with those dealing with crimes and sexual offences, the Sexual Offences Act 2003 came into force on 1 May 2004" (The Office for Criminal Justice Reform, 2006, p.12). The sexual offences act, 2003 has revealed a detailed discussion as regards consent in regard to rape. The Law Lords overturned this common law idea that marriage means a man has a 'continual' consent from his wife for sexual activity at any time (R v. R [1992]). Thomas (2005) describes as "[t]his was later brought into statute in 1994, now in Sexual offences Act 2003" (p.11). The present paper is intended to justify whether the guidance of consent as provided in the said enactment is proper or warrants further explanation and amendment. The Sexual Offences Act, 2003 has been designed to make the process easier and convenient for prosecuting people who use physical force to others for having sex despite the unwillingness of the other party. The legislation provides that a person would not be charged with the offence if he or she intends to protect a child from sexually transmitted infection, from physical safety of the child or from becoming pregnant. The Sexual Offences Act 2003 has made a greater legal protection for victims by clarifying the law on consent. Section 1 of the Act states, a person commits an offence of rape if he intentionally penetrates to the vagina, anus or mouth of another person despite her reluctance. The phraseology "reasonable belief" as enunciated in section 1 is determined in regard to the particular context of a given circumstance. Section 74 of the Act defines consent as stating that a person is presumed to give consent if he agrees by choice, and has the freedom and capacity to make tha t choice. Section 75 provides a list of circumstances where it may be considered that the victim or complainant did not consent to the said sexual interaction. From a perusal of section 76, it is clear that if (a) the defendant intentionally deceive the complainant as to the nature or purpose of the relevant act; or (b) the defendant intentionally induce the complainant to consent to the relevant act, it is presumed that the victim did not give his or her consent. As per the provisions of section 79(2) penetration is a continuing act from entry to withdrawal and if the victim consents to penetration but withdraws consent after penetration, the accused must withdraw his penis immediately.Consent in the sexual offences ActConsent must be obtained peacefully and without the use of force or violence. If it is obtained by force, threat or inducement or any other unlawful means, said consent would be declared as void and illegal. The meaning of the term "consent" as given in the Sexual offence act, 2003 is an aiding tool for the juries in deciding whether the victim was able to give or did actually give his or her consent to the said sexual transaction. In this connection, the defendant must show that his belief in consent was reasonable and obtained in due manner and a jury must consider all the circumstances including any step which he has taken to ascertain in determining whether the vi
